ব্যবসায়িক লেনদেন এবং ব্যক্তিগত দেনা-পাওনা নিষ্পত্তিতে চেক একটি অত্যন্ত গুরুত্বপূর্ণ মাধ্যম। বিশ্বাস এবং আস্থার ভিত্তিতেই চেকের গ্রহণযোগ্যতা তৈরি হয়। কিন্তু যখন সেই বিশ্বাস ভঙ্গ হয়, অর্থাৎ প্রাপকের হিসাবে পর্যাপ্ত অর্থ না থাকা বা অন্য কোনো কারণে ব্যাংক কর্তৃক চেক প্রত্যাখ্যাত (Dishonour) হয়, তখন আইনি জটিলতার সৃষ্টি হয়। বাংলাদেশে এই ধরনের পরিস্থিতি মোকাবেলার জন্য শক্তিশালী আইন বিদ্যমান, যা মূলত আলোচ্য দলিল আইন, ১৮৮১ (Negotiable Instruments Act, 1881) দ্বারা নিয়ন্ত্রিত।
এই লেখায় আমরা বাংলাদেশে চেক ডিজঅনার মামলার আদ্যোপান্ত, অর্থাৎ শুরু থেকে শেষ পর্যন্ত যাবতীয় আইনি প্রক্রিয়া, সংশ্লিষ্ট ধারা, উচ্চ আদালতের সিদ্ধান্ত এবং প্রায়োগিক দিকগুলো নিয়ে বিস্তারিত আলোচনা করব, যাতে পাঠক এ বিষয়ে একটি স্বচ্ছ ধারণা লাভ করতে পারেন।
চেক কি?
নেগোশিয়েবল ইন্সট্রুমেন্ট আইন ১৮৮১ এর ৬ ধারায় চেকের সংজ্ঞা দেওয়া হয়েছে। সহজ ভাষায়, চেক হলো কোনো নির্দিষ্ট ব্যাংকের উপর কাটা একটি হস্তান্তরযোগ্য দলিল, যেখানে আদেশদানকারী ব্যক্তি (Drawer) ব্যাংককে নির্দেশ দেন যেন চেকে উল্লিখিত নির্দিষ্ট পরিমাণ অর্থ এর বাহককে (Bearer) বা চেকে উল্লিখিত নির্দিষ্ট ব্যক্তিকে (Payee) বা তার আদেশানুযায়ী অন্য কোনো ব্যক্তিকে চাহিবামাত্র প্রদান করা হয়। এটি মূলত একটি শর্তহীন আদেশ।
চেক ডিজঅনার বা প্রত্যাখ্যান কি?
যখন কোনো ব্যক্তি বা প্রতিষ্ঠান ব্যাংক থেকে টাকা তোলার জন্য চেক উপস্থাপন করে, কিন্তু ব্যাংক নির্দিষ্ট কিছু কারণে সেই চেক অনুযায়ী অর্থ প্রদান করতে অস্বীকৃতি জানায়, তখন তাকে চেক ডিজঅনার বা প্রত্যাখ্যান বলা হয়। প্রাপ্য হিসাবে অপর্যাপ্ত তহবিল (Insufficient Funds) চেক ডিজঅনারের প্রধান কারণ হলেও আরও বিভিন্ন কারণে চেক প্রত্যাখ্যাত হতে পারে।
কোন আইনের অধীনে চেক ডিজঅনারের মামলা হয়?
চেক ডিজঅনার সংক্রান্ত অপরাধ এবং এর বিচার মূলত নেগোশিয়েবল ইন্সট্রুমেন্ট আইন (Negotiable Instruments Act, 1881) এর ১৩৮ থেকে ১৪১ ধারা অনুযায়ী পরিচালিত হয়। এর মধ্যে ১৩৮ ধারাটি সর্বাধিক গুরুত্বপূর্ণ, কারণ এটি চেক ডিজঅনারের অপরাধ, শাস্তি এবং মামলা দায়েরের পদ্ধতি বর্ণনা করে।
চেক ডিজঅনারের কারণসমূহ:
বিভিন্ন কারণে একটি চেক ব্যাংক কর্তৃক প্রত্যাখ্যাত হতে পারে। কিছু সাধারণ কারণ নিচে উল্লেখ করা হলো:
অপর্যাপ্ত তহবিল (Insufficient Funds): চেকের হিসাবে উল্লিখিত পরিমাণ অর্থ জমা না থাকা।
অঙ্ক এবং কথায় টাকার পরিমাণে গরমিল: চেকের অঙ্কে লেখা টাকার পরিমাণ এবং কথায় লেখা টাকার পরিমাণের মধ্যে অমিল থাকা।
স্বাক্ষর অমিল (Signature Mismatch): চেকের উপর প্রদানকারীর স্বাক্ষর ব্যাংকে সংরক্ষিত নমুনা স্বাক্ষরের সাথে না মেলা।
বাসি চেক (Stale Cheque): চেকে উল্লিখিত তারিখ থেকে ৬ মাস (বা চেকে উল্লিখিত মেয়াদকাল) অতিক্রান্ত হওয়ার পর চেক উপস্থাপন করা।
পোস্ট-ডেটেড চেক (Post-Dated Cheque): চেকে উল্লিখিত তারিখ আসার আগেই উপস্থাপন করা।
অ্যাকাউন্ট বন্ধ (Account Closed): যে হিসাবের বিপরীতে চেক ইস্যু করা হয়েছে, সেই হিসাব বন্ধ থাকা।
প্রদান স্থগিতের নির্দেশ (Payment Stopped): চেক প্রদানকারী কর্তৃক ব্যাংককে উক্ত চেকের অর্থ প্রদান স্থগিত রাখার নির্দেশ দেওয়া।
চেকে কাটাকাটি বা পরিবর্তন (Alteration/Mutilation): যথাযথ অনুমোদন ছাড়া চেকে কোনো পরিবর্তন বা কাটাকাটি করা হলে।
আইনি বাধা (Legal Bar): আদালতের কোনো আদেশ বা অন্য কোনো আইনি কারণে হিসাবটি জব্দ থাকা।
ধারা ১৩৮: চেক ডিজঅনার সংক্রান্ত মূল আইন:
নেগোশিয়েবল ইন্সট্রুমেন্ট আইন ১৮৮১ এর ১৩৮ ধারায় বলা হয়েছে যে, যদি কোনো ব্যক্তি কোনো ঋণ বা দায় পরিশোধের জন্য কোনো ব্যাংক হিসাব থেকে চেক ইস্যু করেন এবং সেই চেক অপর্যাপ্ত তহবিলের কারণে বা ব্যাংকের সাথে করা চুক্তি অনুযায়ী পরিমাণ অতিক্রম করার কারণে ব্যাংক কর্তৃক প্রত্যাখ্যাত হয়, তবে উক্ত ব্যক্তি একটি অপরাধ করেছেন বলে গণ্য হবেন।
শাস্তি: এই ধারার অধীনে অপরাধ প্রমাণিত হলে, অপরাধী এক বছর পর্যন্ত কারাদণ্ড অথবা চেকে উল্লিখিত অর্থের তিনগুণ পর্যন্ত জরিমানা অথবা উভয় দণ্ডে দণ্ডিত হতে পারেন।
মামলা দায়েরের পূর্বশর্ত (ধারা ১৩৮ এর শর্তাবলী): চেক ডিজঅনার হলেই সরাসরি মামলা করা যায় না। আইন অনুযায়ী কিছু নির্দিষ্ট শর্ত পূরণ করতে হয়:
বৈধ মেয়াদের মধ্যে উপস্থাপন: চেকটি ইস্যুর তারিখ থেকে ৬ মাসের মধ্যে (অথবা চেকে উল্লিখিত মেয়াদকালের মধ্যে, যেটি আগে হয়) ব্যাংকে উপস্থাপন করতে হবে।
ডিজঅনার সংক্রান্ত তথ্যপ্রাপ্তি: ব্যাংক কর্তৃক চেকটি অপর্যাপ্ত তহবিলের কারণে (বা অন্য বৈধ কারণে যা এই ধারার আওতায় পড়ে) ডিজঅনার হতে হবে এবং ব্যাংক থেকে এই সংক্রান্ত রশিদ (Dishonour Slip/Memo) সংগ্রহ করতে হবে।
আইনি নোটিশ প্রেরণ: চেক ডিজঅনার হওয়ার তথ্য জানার ৩০ দিনের মধ্যে চেকের প্রাপক (Payee) বা ধারক (Holder in due course) কর্তৃক চেক প্রদানকারীকে (Drawer) চেকে উল্লিখিত সম্পূর্ণ টাকা পরিশোধের জন্য लिखित আকারে একটি আইনি নোটিশ প্রদান করতে হবে।
প্রেরণ পদ্ধতি: এই নোটিশ সাধারণত রেজিস্ট্রি ডাকযোগে প্রাপ্তি স্বীকারসহ (Registered Post with Acknowledgement Due – AD) প্রেরণ করা হয়। সরাসরি হাতে হাতে দিয়ে প্রাপ্তি স্বীকার সই নেওয়া যেতে পারে, অথবা নির্ভরযোগ্য কুরিয়ার সার্ভিসের মাধ্যমেও পাঠানো যায়, সেক্ষেত্রে প্রাপ্তি স্বীকারের প্রমাণ রাখা আবশ্যক।
বিকল্প পদ্ধতি (পত্রিকায় বিজ্ঞপ্তি): যদি চেক প্রদানকারীর সঠিক ঠিকানা জানা না থাকে, তিনি পলাতক হন বা উদ্দেশ্যপ্রণোদিতভাবে নোটিশ গ্রহণ এড়িয়ে চলেন, সেক্ষেত্রে নোটিশটি একটি বহুল প্রচারিত জাতীয় দৈনিক বাংলা পত্রিকায় বিজ্ঞপ্তি আকারে প্রকাশ করেও জারি করা যেতে পারে। এক্ষেত্রে, পত্রিকায় প্রকাশিত বিজ্ঞপ্তির মূল কপিটি নোটিশ জারির প্রমাণ হিসেবে আদালতে দাখিল করতে হবে। অনেক সময় রেজিস্ট্রি ডাকে নোটিশ প্রেরণের পাশাপাশি অতিরিক্ত সতর্কতা হিসেবে পত্রিকায় বিজ্ঞপ্তিও প্রকাশ করা হয়।
টাকা পরিশোধে ব্যর্থতা: নোটিশ পাওয়ার পর (অথবা পত্রিকায় বিজ্ঞপ্তি প্রকাশিত হওয়ার পর নির্ধারিত নিয়ম অনুযায়ী) চেক প্রদানকারী যদি নোটিশে উল্লিখিত সময়সীমার মধ্যে (সাধারণত ৩০ দিন) চেকে উল্লিখিত সম্পূর্ণ টাকা পরিশোধ করতে ব্যর্থ হন, তবেই তার বিরুদ্ধে মামলা করার অধিকার জন্মায়।
মামলা দায়েরের সময়সীমা: চেক প্রদানকারী কর্তৃক টাকা পরিশোধে ব্যর্থ হওয়ার পরবর্তী ৩০ দিনের মধ্যে সংশ্লিষ্ট এখতিয়ারসম্পন্ন আদালতে মামলা দায়ের করতে হবে।
আইনি নোটিশের গুরুত্ব:চেক ডিজঅনারের মামলা দায়েরের জন্য আইনি নোটিশ প্রেরণ একটি অপরিহার্য পূর্বশর্ত। নোটিশে নিম্নলিখিত বিষয়গুলো উল্লেখ থাকা আবশ্যক: চেক ডিজঅনার হওয়ার পূর্ণাঙ্গ বিবরণ (চেক নম্বর, তারিখ, টাকার পরিমাণ, ডিজঅনারের তারিখ ও কারণ)।চেকে উল্লিখিত সম্পূর্ণ টাকা পরিশোধের জন্য সুস্পষ্ট দাবি। নোটিশ প্রাপ্তির ৩০ দিনের মধ্যে উক্ত টাকা পরিশোধ করার সময়সীমা উল্লেখ। পরিশোধে ব্যর্থ হলে নেগোশিয়েবল ইন্সট্রুমেন্ট আইন ১৮৮১ এর ১৩৮ ধারার অধীনে আইনি ব্যবস্থা গ্রহণ করা হবে মর্মে সুস্পষ্ট হুঁশিয়ারি।
সঠিকভাবে নোটিশ প্রেরণ ও এর প্রাপ্তি বা প্রেরণের প্রমাণ (যেমন: রেজিস্ট্রি ডাকের রসিদ ও এডি স্লিপ, অথবা পত্রিকায় প্রকাশিত বিজ্ঞপ্তির কপি) মামলার জন্য অত্যন্ত জরুরি।
কোথায় মামলা দায়ের করতে হবে? (এখতিয়ার – Jurisdiction)
নেগোশিয়েবল ইন্সট্রুমেন্ট আইন ১৮৮১ এর ১৩৮ ধারার অধীনে চেক ডিজঅনারের মামলা একটি ফৌজদারি অপরাধ এবং এটি প্রথম শ্রেণীর ম্যাজিস্ট্রেট আদালত (Court of First Class Magistrate) বা মেট্রোপলিটন ম্যাজিস্ট্রেট আদালত (Metropolitan Magistrate Court) -এ দায়ের করতে হয়।
এখতিয়ার মূলত নির্ধারিত হয় যেখানে অপরাধ সংঘটিত হয়েছে তার ভিত্তিতে। উচ্চ আদালতের বিভিন্ন সিদ্ধান্ত অনুযায়ী, চেক ডিজঅনারের মামলা নিম্নলিখিত যেকোনো একটি স্থানে দায়ের করা যেতে পারে:
যে ব্যাংকে চেক উপস্থাপন করা হয়েছিল: অর্থাৎ যে ব্যাংক শাখা চেকটি ডিজঅনার করেছে, সেই শাখাটি যে আদালতের স্থানীয় এখতিয়ারের মধ্যে অবস্থিত।
যেখান থেকে আইনি নোটিশ প্রেরণ করা হয়েছে: নোটিশ প্রদানকারী যে ঠিকানায় বা যে পোস্ট অফিস থেকে নোটিশ প্রেরণ করেছেন, সেই এলাকা যে আদালতের এখতিয়ারভুক্ত। (তবে এই এখতিয়ার নিয়ে ভিন্নমত থাকতে পারে এবং প্রথমোক্ত এখতিয়ারটি বেশি গ্রহণযোগ্য)।
সাম্প্রতিক প্রবণতা ও উচ্চ আদালতের নির্দেশনা: সাম্প্রতিক সময়ে উচ্চ আদালতের কিছু পর্যবেক্ষণে এটা প্রতীয়মান হয় যে, যে ব্যাংকের শাখায় চেকটি নগদায়নের জন্য জমা দেওয়া হয়েছিল এবং প্রত্যাখ্যাত হয়েছে, সেই শাখা যে আদালতের এখতিয়ারভুক্ত, সেই আদালতেই মামলা দায়ের করা অধিকতর যুক্তিযুক্ত।
মামলা দায়েরের পদ্ধতি ও প্রয়োজনীয় কাগজপত্র:নির্ধারিত এখতিয়ারসম্পন্ন ম্যাজিস্ট্রেট আদালতে একজন আইনজীবীর মাধ্যমে নালিশি মামলা (Complaint Case বা C.R. Case) দায়ের করতে হয়। মামলার আরজির (Petition of Complaint) সাথে নিম্নলিখিত কাগজপত্র সংযুক্ত করতে হবে:
মূল চেক (Original Cheque): ডিজঅনার হওয়া চেকটির মূল কপি।
ডিজঅনার স্লিপ/মেমো (Dishonour Slip/Memo): ব্যাংক কর্তৃক প্রদত্ত চেক ডিজঅনারের মূল রশিদ।আইনি নোটিশের কপি (Copy of Legal Notice): চেক প্রদানকারীকে পাঠানো আইনি নোটিশের একটি অনুলিপি।
ডাক রশিদ ও প্রাপ্তি স্বীকার (Postal Receipt & AD Slip) / পত্রিকার কপি: রেজিস্ট্রি ডাকযোগে নোটিশ পাঠানোর মূল রশিদ ও সম্ভব হলে প্রাপ্তি স্বীকার (এডি) স্লিপ অথবা পত্রিকায় প্রকাশিত বিজ্ঞপ্তির মূল কপি।
অন্যান্য প্রমাণাদি (যদি থাকে): যেমন, ব্যবসার চুক্তিপত্র, টাকা পাওয়ার রশিদ বা অন্য কোনো প্রাসঙ্গিক দলিল যা ঋণ বা দায়ের অস্তিত্ব প্রমাণ করে।
ওকালতনামা: আইনজীবীকে মামলা পরিচালনার ক্ষমতা অর্পণ সংক্রান্ত দলিল।
আদালতে নির্দিষ্ট হারে কোর্ট ফি জমা দিয়ে মামলা ফাইল করতে হয়।
আদালতের বিচার প্রক্রিয়া:
মামলা গ্রহণ ও জবানবন্দি: আদালত নালিশি আরজি এবং সংযুক্ত কাগজপত্র পর্যালোচনা করে মামলাটি আমলে নেওয়ার মতো কারণ আছে কিনা তা দেখেন। সাধারণত, বাদীর বা তার আইনজীবীর সংক্ষিপ্ত জবানবন্দি (Initial Deposition) রেকর্ড করা হয়।
আসামির প্রতি সমন/ওয়ারেন্ট জারি: আদালত সন্তুষ্ট হলে অভিযুক্তের (চেক প্রদানকারী) প্রতি সমন (Summons) জারি করেন। অভিযুক্ত সমন পেয়ে আদালতে হাজির না হলে তার বিরুদ্ধে গ্রেফতারি পরোয়ানা (Warrant of Arrest) জারি হতে পারে।
জামিন (Bail): অভিযুক্ত আদালতে হাজির হয়ে বা গ্রেফতারের পর জামিনের আবেদন করতে পারেন। চেক ডিজঅনারের মামলা সাধারণত জামিনযোগ্য (Bailable), তবে আদালত পরিস্থিতি বিবেচনায় জামিন মঞ্জুর বা নামঞ্জুর করতে পারেন।
অভিযোগ গঠন (Charge Framing): মামলার উপাদান থাকলে আদালত আসামির বিরুদ্ধে নেগোশিয়েবল ইন্সট্রুমেন্ট আইন ১৮৮১ এর ১৩৮ ধারায় (প্রয়োজনে অন্যান্য ধারা যুক্ত করে) অভিযোগ গঠন করেন। আসামিকে অভিযোগ পড়ে শোনানো হয় এবং তিনি দোষ স্বীকার করেন কিনা তা জিজ্ঞাসা করা হয়। দোষ স্বীকার না করলে বিচার শুরু হয়।
সাক্ষ্য গ্রহণ (Evidence):
বাদীপক্ষের সাক্ষ্য: বাদীপক্ষের সাক্ষীগণ (সাধারণত বাদী নিজে এবং ক্ষেত্রবিশেষে ব্যাংকের কোনো কর্মকর্তা) সাক্ষ্য প্রদান করেন এবং তাদের সাক্ষ্য প্রমাণের জন্য দালিলিক প্রমাণাদি (মূল চেক, ডিজঅনার স্লিপ, নোটিশ, রশিদ ইত্যাদি) উপস্থাপন করেন। আসামিপক্ষ তাদের জেরা (Cross-examination) করার সুযোগ পায়।
আসামিপক্ষের সাক্ষ্য (Defence Witness): আসামিপক্ষ চাইলে নিজেদের স্বপক্ষে সাক্ষ্যপ্রমাণ উপস্থাপন করতে পারে এবং বাদীপক্ষ তাদের জেরা করতে পারে।
আসামির বক্তব্য (Accused Statement): ফৌজদারি কার্যবিধির ৩৪২ ধারা অনুযায়ী আদালত আসামির বক্তব্য রেকর্ড করেন।
যুক্তিতর্ক (Argument): উভয় পক্ষের আইনজীবী মামলার সাক্ষ্যপ্রমাণ ও আইনি দিক তুলে ধরে যুক্তিতর্ক উপস্থাপন করেন।
রায় (Judgment): আদালত উভয় পক্ষের যুক্তিতর্ক এবং উপস্থাপিত সাক্ষ্যপ্রমাণ বিশ্লেষণ করে রায় ঘোষণা করেন। রায়ে আসামিকে দোষী সাব্যস্ত করে শাস্তি প্রদান অথবা নির্দোষ ঘোষণা করে খালাস দেওয়া হতে পারে।
আপিল:
নিম্ন আদালতের রায়ে সংক্ষুব্ধ পক্ষ (বাদী বা আসামি) দায়রা জজ আদালতে (Court of Sessions Judge) আপিল দায়ের করতে পারেন। আবার দায়রা জজ আদালতের রায়ে সংক্ষুব্ধ পক্ষ (বাদী বা আসামি) মহামান্য হাইকোটে আপিল করতে পারেন।
সাজা বা জরিমানার বিরুদ্ধে আপিল: আসামি যদি দোষী সাব্যস্ত হন এবং দণ্ডপ্রাপ্ত হন, তবে তিনি রায়ের ৩০ দিনের মধ্যে দায়রা জজ আদালতে আপিল করতে পারেন। নেগোশিয়েবল ইন্সট্রুমেন্ট আইন, ৬ অনুযায়ী, দণ্ডিত আসামিকে আপিল দায়ের করার জন্য চেকে উল্লিখিত অর্থের ন্যূনতম ৫০% (অথবা আদালত কর্তৃক নির্ধারিত পরিমাণ) সংশ্লিষ্ট আদালতে জমা দিতে হবে। উচ্চ আদালতের বিভিন্ন সিদ্ধান্তে এই জমার পরিমাণ নিয়ে ভিন্ন ভিন্ন নির্দেশনা এসেছে, তাই আপিলের সময় অবশ্যই সর্বশেষ আইনি অবস্থান যাচাই করতে হবে।
খালাসের বিরুদ্ধে আপিল: আসামি যদি খালাস পেয়ে যান, তবে বাদীপক্ষও সেই রায়ের বিরুদ্ধে আপিল বা রিভিশন দায়ের করতে পারে।দায়রা জজ আদালতের রায়ের বিরুদ্ধে সংক্ষুব্ধ পক্ষ পরবর্তীতে হাইকোর্ট বিভাগে রিভিশন দায়ের করতে পারে।
আসামিপক্ষের আত্মপক্ষ সমর্থন (Defence):চেক ডিজঅনার মামলায় অভিযুক্ত ব্যক্তি বা প্রতিষ্ঠান নিম্নলিখিত কিছু যুক্তি বা প্রমাণ উপস্থাপনের মাধ্যমে আত্মপক্ষ সমর্থন করতে পারে:
ঋণ বা দায়ের অনুপস্থিতি: চেকটি কোনো বৈধ ও আইনত বলবৎযোগ্য ঋণ বা দায় পরিশোধের জন্য দেওয়া হয়নি। যেমন, চেকটি জামানত (Security Cheque) হিসেবে দেওয়া হয়েছিল, কিন্তু মূল লেনদেন সম্পন্ন হয়নি বা ঋণ পরিশোধ হয়ে গেছে।
চুরি বা হারানো চেক: চেকটি চুরি হয়ে গিয়েছিল বা হারিয়ে গিয়েছিল এবং তা অবৈধভাবে ব্যবহার করা হয়েছে (এক্ষেত্রে থানায় জিডি বা মামলা দায়েরের প্রমাণ গুরুত্বপূর্ণ)।
চেকে জালিয়াতি বা পরিবর্তন: চেকটিতে প্রাপক কর্তৃক কোনো পরিবর্তন বা জালিয়াতি করা হয়েছে।
আইনি নোটিশ না পাওয়া: বাদীপক্ষ আইন অনুযায়ী সঠিক পদ্ধতিতে ও সঠিক ঠিকানায় নোটিশ প্রেরণ করেনি বা আসামি নোটিশ পায়নি (অথবা পত্রিকায় প্রকাশিত নোটিশ আইনানুগভাবে হয়নি)।
নোটিশ পাওয়ার পর টাকা পরিশোধ: আইনি নোটিশ পাওয়ার ৩০ দিনের মধ্যে চেকে উল্লিখিত টাকা পরিশোধ করা হয়েছে।
হিসাব বন্ধের পূর্ব ঘোষণা: চেক উপস্থাপনের আগেই ব্যাংককে হিসাব বন্ধ বা লেনদেন স্থগিতের বিষয়ে জানানো হয়েছিল এবং প্রাপককেও অবহিত করা হয়েছিল।
স্বাক্ষর অমিল: চেকে প্রদানকারীর স্বাক্ষর সঠিক নয়।
মেয়াদোত্তীর্ণ চেক: চেকটি মেয়াদ উত্তীর্ণ হওয়ার পর ব্যাংকে উপস্থাপন করা হয়েছে।
